The ICD3 uses a large FPGA to implement the high-speed USB interface. It may be economically inviable to make small batches because of the high cost of the FPGA. Besides, I don't think Microchip has published the FPGA configuration file or the PIC firmware. If the FPGA boots from an external memory then this is a no-issue, but there are FPGAs with protected internal memory. Also, the firmware updates may be encrypted and the boot-loader in the PIC may be well secured.
