If it quacks like a duck and walks like a duck, everybody is free to hear and see this and draw their conclusions -- if they want a duck, they should get it, and if not, they should look elsewhere. I think legal action is only required if it is a duck but is made so it doesn't quack like one and doesn't walk like one.
