Their choice. In my country consumer law states that if I buy something from X, it is X's responsibility that I get something that is OK. That Y manufactured the thingy does not matter. Maybe US law is different, but by Dutch law the OP should have contacted Sparkfun, not Olimex. (I sell Olimex stuff too, and when it does not work I expect my customers to contact me, and I must deal with it.
