Right now the former is > true, so live with > it, or... Actually in the UK (where this particular case that sparked the discussion occurred) gay marriage is legal (as of about 2-3 years ago). It isn't actually a marriage ceremony, but a 'civil partnership' ceremony that is performed to recognise the relationship.
