Linus Torvalds is far more the pragmatist, indeed for a very long time kernel versioning was handled by a closed-source package. One must be very cautious with many articles on what is happening in the world of kernel development. There are a lot of people involved, and many articles blow discussions out of proportion. As for the matter of lawyers and open source, I anticipate there's quite a few lawyers involved in using just about any third-party code. On this Linux is by no means unique. Openness is an advantage to all of us, sharing ideas can only enrich humanity. That being said, the reason to use Linux is because it's better for the application.
