Apparently the issue is that very few of those involved on the money end (universities, pharma companies, congress) has an interest in /really/ clearing this up -- seemingly because it is feared that once you open the issue, starting with describing current and past practices and the sometimes "inconvenient" consequences, the public wouldn't like that and any clarification of how things should work is then likely to be different from how they do work. So they don't clarify this... and leave it up to the courts.
