I had a similiar situation involving a client after I did alot of work on some rental property he wanted to sell. I did what the guy wanted, even had a contract. But when I went to pick up the 3800.00 check ( this was about 9 years ago) He said the FHA guy did not want to pass it becasue there was not enough clearance on some of the sidine. Funny thing is, I tried to tewll the owner this but he insisted on doing it his way. To make a long story short. We ended up suing each other and prior to court we had to go through mediation. Basically I got half of my money. This taught me a lesson. never listen to a client when you know it is wrong. Had I went on to court, I would have probably won. yet by the time I figured in the cost of the lawyer ( and they aint cheap) I would have came out with less than I got. My advice. see if the local courts have a mediator and enlist his services. Usually they are pro-bono and you may be able to resolve the issue. First steps to call the guy and see exactly what he wants to settle. if this is unreasonable , make him an offer. If that don't work. pray. Courts can go either way these days. I think the justice system is a discrace and it boils down to money rather than right or wrong anymore.
