That would be a difference if it was true - I have *never* agreed to any adware being installed on any of my computers. I have never even been asked for my permission, in fact! Under English law, spam and adware are both now illegal, but as for how you catch the perpetrators (and whether the law could be applied internationally) I have no idea...
