There are a number of legal cases in progress in parts of Europe on this very subject. Under European Law (each country actually has its own version of it), goods must be "fit for the purpose for which they are sold". Some years ago, I got a full refund from M$ for an opened (and installed) OS which simply didn't work properly. I cited the British "Sales of Goods Act", and after some delay and debate, M$ were forced (via their reseller) to refund in full! In the instance of a pre-installed operating system, the computer supplier has to held liable.....
